Buying Agricultural Land in Haryana: CLU, Ceiling & the Real Rules

Haryana has no eligibility bar at all — the real compliance work is Change of Land Use, not who's allowed to buy. Here's what actually gates a purchase in this state.

Quick answer: Haryana has no non-agriculturist bar and no domicile requirement — any Indian citizen can buy agricultural land here. The real gatekeeper isn't eligibility, it's Change of Land Use (CLU) — required before agricultural land in a DTCP-notified controlled area can be used for anything else, including a farmhouse.

Who can buy agricultural land in Haryana

Haryana places no restriction on who can purchase agricultural land — no bona fide agriculturist requirement, no domicile test. This makes it, alongside Rajasthan, one of the more genuinely open states in this platform's corridor. The compliance burden here shows up later in the process, at the point of actually using the land for something other than farming.

Ceiling limits

Under the Haryana Ceiling on Land Holdings Act, 1972 (amended 2011), a family may retain up to approximately 7.25 hectares (~18 acres) of first-class irrigated land, with a larger allowance for lower-quality land. Non-agricultural (urban/industrial) land has carried no ceiling since the 2011 amendment.

A farmhouse-marketed plot without CLU is not legally usable as one

In DTCP-notified "controlled areas" — this includes Gurugram, Faridabad, Sohna, Palwal and other NCR-adjacent belts — agricultural land must be CLU-cleared by the Directorate of Town & Country Planning before any residential, commercial or farmhouse use. This is the single most important check in Haryana, more consequential than the (largely absent) eligibility question. Ask for the parcel's CLU status directly, in writing — a plot marketed as "farmhouse-ready" without confirmed CLU is not actually legally usable for that purpose yet.

CLU status varies parcel by parcel, not just by locality — two adjacent plots can have different CLU status depending on individual application history. Never assume CLU based on neighbouring development.

Punjab Land Preservation Act, 1900 — still active in parts of Haryana

Despite its name, this century-old soil-erosion law remains active in notified areas across ten Haryana districts, including parts of Gurugram, Faridabad and Palwal. Land inside a notified PLPA area may face restrictions on clearing or construction regardless of ownership status. This is a genuinely under-known restriction — confirm PLPA notification status for any parcel in these districts specifically.

A separate CLU-conversion multiplier (roughly 3–5×) applies to stamp duty when agricultural land is being converted to non-agricultural use, in addition to the base rate above. Collector rates have been revised upward by 75–145% since October 2024 across several districts — confirm the current rate rather than relying on older figures.

NRI & OCI buyers

As everywhere in India, FEMA 1999 prohibits NRIs and OCIs from purchasing agricultural land, plantation property or farmhouse land in Haryana. NRIs may purchase CLU-cleared residential or commercial property without this restriction.

Haryana answering "yes, you can buy" is the easy part. "Is this specific plot CLU-cleared for what you want to do with it" is the question that actually matters.
