Can You Build a Farmhouse Without CLU? State by State (2026)

When a farmhouse on agricultural land needs a change of land use, when a farmhouse policy or byelaw works instead, and what happens to a house built without permission.

Many buyers hear two opposite things: "you need CLU before you build" and "a farmhouse on farmland needs no conversion". Both can be true, depending on the state, the zone and what you call a farmhouse. This page sets out what we could confirm from government documents and reports, with the limits stated, so that you know which question to ask the planning office before you pay.

The short answer

It depends on the state and on the route the state gives for farmhouses. In some states the farmhouse itself is a category inside the land use change process, so the permission is the CLU. In others the byelaws allow a farmhouse in an agricultural zone subject to conditions, and the open question is whether a separate conversion order is also needed. A third group of rules, such as tourism policies, exempts specific uses from conversion. A fourth risk is that nothing allows what you plan to build.

Your safest approach is to treat building without the permission your plot needs as unlawful until the planning authority tells you in writing that it is not. The sections below show what we found. Our general guide to change of land use in India explains CLU, and CLU charges and fees by state covers costs where we could confirm them.

What CLU does and what a farmhouse permission does

Change of land use (CLU) moves land from an agricultural use to a non-agricultural use in law, usually with a fee and conditions. A farmhouse permission lets you put a limited residential structure on land that stays mostly agricultural. These can be separate steps or one step. The worry for a buyer is that a seller says "farmhouse allowed" while the land has neither. See farmhouse rules in India and farmhouse construction norms.

Farm buildings are not the same as a farmhouse

A pump house, a tool shed or a store for produce is a farm structure, not a dwelling. Many states treat these differently from a house that people live in. We could not confirm the size and use limits for farm structures in each state from an official text, so do not use "farm shed" as a back door for a house. If you want to live on the land, you need the permission for a dwelling. Our types of land page explains the categories.

What happens if you build without permission

The documents and reports we read show the types of action that follow:

  • Sealing and penal action. The law firm summary of the Haryana policy says a misused farmhouse will be sealed and penal action may follow under Section 12 of the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963.
  • Notices and demolition. A Tribune report of September 2025 said GMADA has sealed and demolished such structures in several villages near Chandigarh and issued at least 62 show-cause notices since 2023, as stated before the National Green Tribunal.
  • Refusal to regularise. A Tribune report of August 2025 said an Eco-Tourism Development Committee rejected regularisation requests from about 90 farmhouse owners because their structures violated guidelines.
  • Himachal Pradesh. The Town and Country Planning Act copy we read provides penalties for unauthorised development in Section 38 and powers to require removal or restoration in Section 39.
  • Practical problems: no building approval means trouble with electricity and water connections, loans and resale.

Questions to ask the planning office

  1. Which planning authority or department has jurisdiction over this khasra number, and which master plan or controlled area applies?
  2. Is a farmhouse allowed on this plot, under which rule, and what is the minimum area?
  3. Does a farmhouse here need a change of land use order, or only a building permission? Please state this in writing.
  4. What are the ground coverage, height and use limits?
  5. What documents do you need, and what fees apply? We could not confirm fees, so ask for a written schedule.
  6. Is the plot affected by any restriction: forest, floodplain, eco-sensitive zone, road widening or acquisition? See government acquisition notices.
  7. Can the permission be transferred to a buyer, and for how long is it valid?

Keep the written answer. If the office will not answer in writing, treat that as a warning. Combine this with the checks in farmhouse land for sale: what to check and minimum land for a farmhouse by state.

If you decide to buy without CLU

Some buyers buy agricultural land with the plan to apply later. If you do, price it as agricultural land, pay the balance only after the order, and put a refund clause in the agreement. Do not start construction before approval. Have a lawyer draft the clauses and verify title first; see how to verify land title. For buyer-eligibility problems, see can a non-farmer buy agricultural land.

What is unconfirmed

We did not open the Haryana policy notification, the Jaipur bye-laws, the Uttarakhand cabinet decision or the Punjab farm-stay notification; each comes from a summary or press report. We could not confirm whether Uttar Pradesh or Rajasthan require a separate conversion order for a farmhouse that the byelaws permit, nor any fee. We did not research each state's rules on farm structures. This page is general information, not legal advice.

Frequently Asked Questions

Can I build a farmhouse on agricultural land without CLU?
It depends on the state and the rule. In Haryana the reported farmhouse policy runs through a CLU application. In other states we could not confirm. Ask the planning office in writing.
Is a farmhouse permission the same as CLU?
Not necessarily. It may be a separate permission or part of the CLU process, depending on the state.
What happens if I build without permission?
Sealing, notices, demolition and refusal to regularise have been reported near Chandigarh. Loans and resale also become difficult.
Does Uttarakhand allow building on farmland without land use change?
A December 2025 cabinet decision was reported for resorts on agricultural land without a change in land use. We could not confirm it covers private farmhouses.
Does Punjab exempt farm stays from CLU?
A 2026 farm-stay policy is reported to exempt registered units within its limits from CLU fees and separate NOCs. We could not open the notification.
Can I build a farm shed without CLU?
Farm structures are treated differently from dwellings, but we could not confirm the limits in each state. Ask the authority.
Who gives CLU permission?
It varies by state. See the state CLU pages.
Can I get an approval later and regularise?
Regularisation is not assured. A Tribune report said requests from about 90 owners were rejected near Chandigarh.
Is a pending CLU enough?
No. A pending application is not a granted order. See the CLU trap page.
What should I carry to the planning office?
The record of rights, the map, the seller's deed, an ID and your building plan, plus the questions in this guide.
