Who can buy agricultural land in Maharashtra
Restricted by occupation, not state of origin: under Section 63 of the Maharashtra Tenancy and Agricultural Lands Act (MTAL), 1948, agricultural land can only be freely transferred to a certified agriculturist — someone who personally cultivates land, including through family or supervised hired labour. This applies even to an agriculturist of another state — a Punjab farmer buying in Maharashtra still needs to satisfy Section 63. Non-agriculturists need District Collector permission, typically 3–6 months, and it is not guaranteed.
A genuinely common workaround: because Rajasthan and Madhya Pradesh allow non-farmers to buy agricultural land freely, some buyers first acquire land in one of those states, obtain the resulting land-revenue record, and use it to demonstrate agriculturist status for a subsequent Maharashtra purchase. This is a real, documented practice — not this platform's recommendation — and its legal robustness should be confirmed with a Maharashtra-qualified advisor before relying on it.
What doesn't require Section 63 permission: land already classified non-agricultural in revenue records; land within Municipal Corporation or Council limits; leasing agricultural land for cultivation up to 2 years; purchase for bona fide industrial use or a special township project (Section 63-1A); and land held via a registered cooperative farming society. Inheritance and bequest to a non-agriculturist heir also remain valid regardless of Section 63.
Conversion is separate from purchase: under Section 44 of the Maharashtra Land Revenue Code, agricultural land cannot be used for construction without a formal conversion order. Building without one is illegal, cannot receive an Occupation Certificate, and is subject to demolition. A 2026 amendment (effective 15 April 2026) replaced the older recurring non-agricultural assessment with a one-time conversion premium under Section 47 MLRC.
Stamp duty — the Ready Reckoner rate: stamp duty is calculated on the higher of the government's annually-updated Ready Reckoner rate (Maharashtra's equivalent of a circle rate) or the actual transaction value. Always verify the current rate for the specific location at igrmaharashtra.gov.in before finalising a price. Any project above 500 sq m or 8 units must be MahaRERA-registered — verify at maharera.mahaonline.gov.in.
NRI & OCI buyers: FEMA 1999's national prohibition on NRI/OCI agricultural land purchase applies in Maharashtra exactly as elsewhere in India.
