Resort on Agricultural Land: Rules and Permissions (2026)

Why a resort, farm stay or homestay is a different use from a farmhouse, which permissions a buyer should ask for, and what recent State announcements do and do not settle.

Farmland India Reviewed Β· Updated October 2026 Β· Official sources linked below

A resort is a commercial use. Agricultural land is, by default, meant for agriculture, so running paying guests on it normally needs a permission that a plain farmhouse may not. Some States have recently announced tourism-friendly policies, but most of what we found is press reporting, not the notified text. This guide shows how to test any resort plan on agricultural land (kheti ki zameen) before you buy.

Why a resort is not a farmhouse

A farmhouse is a residence on farmland. A resort sells rooms, food or events to the public. Revenue law, town planning law and tourism rules treat these as separate uses. Our guide to farmhouse rules in India explains the residence side and shows that States differ on plot size and ground coverage. A resort starts where that guide stops.

The first test is the land itself. Check whether the land record shows the plot as agricultural, and whether any change of land use (CLU) has been granted. See change of land use in India and agricultural land versus commercial land. A commercial use on land that is still recorded as agricultural is the commonest reason a resort plan fails.

The second test is who may buy. In some States a buyer who is not a farmer, or not a resident, needs a permission before the sale. Our domicile and farmer status rules by State page sets out what we could and could not confirm.

The permission ladder for any resort plan

Work through these in order. A resort plan that skips a step can be stopped later, even after the sale deed is registered.

  1. Buyer eligibility: is a permission needed to buy agricultural land in this State, and does it limit the use?
  2. Land use: is conversion from agricultural use required, who grants it and what fee applies? See CLU charges and fees by State.
  3. Planning: does the plot fall inside a master plan or development authority area, and which zone? See land use zones explained and how to read a master plan.
  4. Building approval: sanctioned plan, coverage, height and access road width as set by the local authority.
  5. Tourism or hospitality registration, where the State has a scheme for hotels, home stays or farm stays.
  6. Operating approvals such as fire safety, food licence, pollution consent and local body trade licence, as the State and the scale require. We could not confirm one national list, so ask the local office for the checklist that applies.
  7. Environmental and forest checks: forest land, eco-sensitive areas, water bodies and floodplains. See water rights and borewells.

What States have announced: read with care

The items below are press reports. We could not open a notified rule for any of them, so treat them as signals and check the official text.

StateWhat was reportedWhat we could not confirm
UttarakhandThe State cabinet was reported on 10 December 2025 to allow resorts on agricultural land without a change in land use, with approach road width reduced to six metres in hills and nine metres in plains. The notified order, its conditions, and how it fits the 2025 land law. The report itself said officials were not sure the two align and that clarity was expected.
Himachal PradeshA Cabinet sub-committee was reported on 22 October 2024 to recommend that non-Himachalis who bought land under Section 118 should not run commercial activity such as homestays on it.Whether the Cabinet adopted it. It was a recommendation when reported.
PunjabThe Cabinet was reported to approve a Farm Stay Policy 2026 that lets farmers use a small part of their land for farm stays and rural lodging without disturbing farming. The policy text, minimum land, CLU treatment and registration steps.
HaryanaOur farmhouse guide describes an eco-friendly farmhouse policy that bars commercial activity on approved land. The policy notification itself and any separate tourism route.

See agricultural land rules in Uttarakhand, Section 118 in Himachal Pradesh, agricultural land rules in Punjab and Haryana for the base position in each State.

Hill States need extra care

In the hill States the buyer rule and the use rule interact. In Himachal Pradesh, Section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, 1972 bars transfer of land to a non-agriculturist without the State Government's prior permission, as reported by LiveLaw on the Supreme Court judgment in Ajay Dabra v Pyare Ram (31 January 2023). A permission given for self use may not allow commercial use, which is why the 2024 sub-committee report matters. Read it as a warning to ask what use the permission allows.

In Uttarakhand the 2025 land amendment is reported to bar outsiders from buying agricultural and horticultural land in 11 of 13 districts. A resort buyer from outside the State should confirm both the buying route and the resort route in writing. We could not read the amended Act text, so we do not state clause numbers.

Ask what use the permission allows

If a State permission or a conversion order is part of your plan, read the order itself. Check the purpose stated, any condition against commercial use, and whether it covers the whole plot or a part.

Farm stay, homestay and resort are not the same

States that encourage rural tourism often create a lighter category, usually called a farm stay or home stay, for a few rooms in the farmer's own house with the farm still working. A resort with many rooms, a restaurant, event lawns or a pool is a larger commercial use and is likely to need conversion and full building approval. The line between the two is set by each State's scheme, and we could not confirm the room or area limits in any of the schemes named above.

Before you pay, ask the tourism department or the district office two questions in writing. What is the maximum number of rooms in the farm stay category? What happens to the category if the owner is not a farmer? A scheme meant for farmers may not suit an investor who buys the land only to build rooms.

Buyer checks before paying a token

  • Get the current land record (jamabandi, khatauni or fard) and confirm the recorded land use. See jamabandi and fard explained.
  • Ask for any existing CLU or conversion order and compare the khasra numbers with the plot.
  • Ask the local authority for a written reply on whether a resort is allowed on that khasra, not a verbal assurance from the seller or broker.
  • Check the plot against floodplain, forest and water body maps. See how to check government acquisition notices too.
  • Check road access and width, since the Uttarakhand report shows that approach road width is part of the rules.
  • Confirm electricity and water load availability for commercial use.
  • Keep a clause in the agreement that lets you withdraw and recover your money if the permission is refused. See agreement to sell versus sale deed.

General information, not legal advice

Land law is a State subject and changes by notification. Use this page to prepare questions, then confirm the current rule with the revenue office, the local development authority or a lawyer before you pay any money.

Money and tax points

Banks treat a resort differently from a farmhouse or farmland, and the loan product, if any, depends on the lender. We do not state rates or products. See land loans in India and farmland as loan collateral for the general picture.

A commercial use also changes tax treatment in ways that need an accountant: conversion charges, property tax on the building, GST on services you sell, and income tax on the income. The Income-tax Act, 2025 replaced the 1961 Act for tax years starting 1 April 2026, so section numbers have changed. We state no rates here. Tax rules change; check the current year on the official site. See tax benefits of agricultural land for what applies to farming income, which a resort is not.

What is unconfirmed

We could not confirm the notified text of the Uttarakhand resort decision, the Himachal Pradesh Cabinet decision, the Punjab Farm Stay Policy 2026 or any Haryana tourism route. We could not confirm room limits, minimum land, conversion fees, or the full list of operating licences for any State. We did not open the Himachal Pradesh Tenancy and Land Reforms Act or the Uttarakhand land amendment in the original. Treat this page as a checklist and mark any claim about a State scheme as unconfirmed until you hold the official order.

Frequently Asked Questions

Can I build a resort on agricultural land?
Not as a matter of right. A resort is a commercial use, and agricultural land normally needs a permission or conversion first. Some States have announced exceptions, which you must confirm in the notified text.
Is a farm stay the same as a resort?
No. A farm stay is usually a small number of rooms alongside a working farm under a State scheme. A resort is a larger commercial use. We could not confirm the room limits in any scheme.
Did Uttarakhand allow resorts on agricultural land?
A December 2025 report said the cabinet allowed resorts on agricultural land without a change in land use. The same report said officials were unsure how it fits the 2025 land law. Check the notified order.
Can a non-Himachali run a homestay on land bought under Section 118?
An October 2024 report said a Cabinet sub-committee recommended against it. We could not confirm the final decision, so read the permission order for your land.
Do I need a CLU for a resort?
Usually a change of land use is the first question. Some State announcements say otherwise, so ask the revenue or planning office in writing. See our change of land use guide.
Does Punjab allow farm stays?
The Cabinet was reported to approve a Farm Stay Policy 2026 for farmers. We could not confirm the minimum land, CLU treatment or registration steps.
Who approves a resort building plan?
The local development authority or the body that controls planning on that land. We could not confirm one rule for all States.
Can NRIs buy farmland to build a resort?
NRIs and OCIs generally cannot buy agricultural land without RBI approval under FEMA. See our page on whether NRIs can buy agricultural land in India.
Will a bank lend for a resort on agricultural land?
It depends on the lender and the land use. Ask the bank for its written policy; rates and products change.
What should I put in the agreement?
A clause that ties payment to the permission you need, a refund if it is refused, and a list of the khasra numbers covered.
