Land law is state law. These rules are maintained on the Uttarakhand page and apply to every district within it.
Kotdwar โ land purchase legal rules
โ Uttarakhand limits who can buy agricultural and horticultural land. Check who you are, which district the land is in, and how it is recorded before anything else.
Who can buy agricultural land? Since 1 May 2025, a person who does not already hold land in Uttarakhand can buy agricultural or horticultural land only in Haridwar and Udham Singh Nagar, and only with prior sanction from the state government (Uttarakhand Act 11 of 2025). Press coverage describes this as a bar in 11 of the 13 districts (Scroll, February 2025); the Act names the two districts and does not count the rest. Buying through a nominee is a compliance risk, and a transfer made on a false affidavit is void under the Act.
The 2025 land law amendment: The Assembly passed the bill on 21 February 2025 (Scroll, February 2025). The Governor gave assent on 30 April 2025, and the Act was notified and took effect on 1 May 2025 (Act text; PTI via The Week, May 2025). The power to allow purchases moved from the District Magistrate to the state government (Business Standard, February 2025). The Chief Minister said land bought on false declarations can vest in the state, and cited 1,883 approvals since 2018 with 599 violations found (Scroll, February 2025).
Haridwar and Udham Singh Nagar: These are the only districts where sanction for such a purchase is possible, and sanction is not automatic. The buyer gives an affidavit that the land will be used only for the stated agricultural or horticultural purpose and must put it to that use within three years or an extended period; a change of use makes the transfer void (Act text). The general power to allow transfers above the ceiling, earlier reported as 12.5 acres, is now confined to these two districts and sits with the state government, which acts on an essentiality certificate (Act text; Business Standard, February 2025). Ask the revenue department which office takes sanction applications before paying a token amount.
Residential land for non-residents: The Act lets a buyer file an affidavit that neither he nor his family has bought more than 250 sq m of land elsewhere in the state for residential use; a false affidavit voids the transfer (Act text; Scroll, February 2025). The text we read does not settle whether 250 sq m is a lifetime count across the family, or how the rule works inside municipal limits, which the Act's extent clause excludes, so take both questions to the Sub-Registrar in writing.
Land-use declaration (Section 143): Section 143 of the parent Act (UP Zamindari Abolition and Land Reforms Act, 1950) deals with declaring agricultural land for other uses, such as a house or farmhouse. We have not re-read the section for this edition, so ask the Sub-Divisional Magistrate which declaration applies before building. Check the land's classification in the khatauni, not in the seller's brochure.
Forest, van panchayat and eco-sensitive land: Land recorded as forest cannot be freely sold or converted, and land near Corbett, Rajaji and other protected areas can fall inside an eco-sensitive zone with construction limits. In November 2025 the Supreme Court directed that zones around tiger reserves be notified within a year (The Week/PTI, November 2025). A plot that looks like farmland can be recorded differently, so ask for the revenue record and the forest position in writing.
NRI & OCI buyers: FEMA 1999 bars NRIs and OCIs from buying agricultural land, plantation land or farmhouse land anywhere in India, Uttarakhand included. That is a central rule, not a state one, and the state Act adds its own conditions on top; read the current RBI notification for the exact wording.
- Purchase: Haridwar & USN only
- State sanction required
- Residential: 250 sq m affidavit
- Section 143 land use
- ESZ & forest checks
- NRI agri: barred (FEMA)

Micro-market overview
Kotdwar โ a foothill gateway town with rail and a Corbett entry
Kotdwar is the plains-edge gateway to Pauri Garhwal, at about 450 m. For anyone searching for land in Kotdwar, the draw is access: Delhi is reported about 216 km away, Dehradun 116 km, Haridwar 70 km and Lansdowne 37 km (approximate road distances, not route-checked), and the town has a railway station that dates from the British period (the year is reported inconsistently, so confirm). An entry to Jim Corbett National Park from the Kotdwar side was reported as opened in November 2017; confirm with the Corbett Tiger Reserve office.
Kotdwar is reported to be a Municipal Corporation, with 40 wards and elections held in 2025; confirm with the State Election Commission or the corporation. We do not quote a town population here because the figures we saw mix town and wider-area counts; use the Census of India 2011 town table. Ask the corporation for the ward map and the date any villages were added to its limits.
The area is reported to have pharmaceutical, polymer, steel and food-processing units, with SIDCUL and BEL industrial areas. Farmland India estimates farm land here at about โน50 lakhโ1.5 crore per acre*, indicative only; the link between that industry and land prices is not measured.
Because Kotdwar is a Municipal Corporation, land within its limits sits outside the 2025 amendment's extent, while villages outside it do not. This boundary is the key check; see the land-rules block and the Pauri Garhwal district page.

Kotdwar โ land rules that apply here
This is a research note on a fast-changing law, not legal advice. Items marked confirm have a single source or conflicting sources.
โ The governing text is the Uttarakhand (Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1950) (Amendment) Act, 2025 (Uttarakhand Act No. 11 of 2025, dated 1 May 2025), read as a PDF on a government cloud host (Act text, Oct 2026). Its extent clause covers the whole State "except the areas included and to be included from time to time in any Municipal Corporation, Nagar Panchayat, Nagar Palika Parishad and Cantonment Board limits". We read it through a summary tool, not the Gazette portal, so confirm the wording.
โ Inside its extent, the Act lets a buyer from outside give an affidavit that neither they nor their family has bought more than 250 sq m elsewhere in the State for residential use, and allows agricultural or horticultural purchase only in Haridwar and Udham Singh Nagar, with prior State Government sanction. Press reports call the other 11 districts, including Pauri Garhwal, closed to outsiders for agricultural land; some say "less than" 250 sq m where the Act says "more than". The Act text governs; confirm with a local lawyer.
โ Kotdwar is reported to be a Municipal Corporation (confirm the notification). By the Act's extent clause, land inside corporation limits is outside the amended Act, but limits are 'included and to be included from time to time', so newly added villages may be in or out. Ask for a written boundary certificate per khasra; we did not find the notified limit.
โ Land outside the limit is inside the Act: agricultural land is closed to outside buyers on the press reading and a residential plot is limited to the affidavit route. Municipal land is still subject to master-plan, zoning and building rules; we did not read the Kotdwar master plan.
โ Near the Corbett side, forest, buffer-zone and eco-sensitive-zone rules can apply; see Corbett's Jim Corbett ESZ guide on the site and confirm which side of any boundary a parcel sits.
โ Reported stamp duty is 5% (3.75% for women up to Rs 25 lakh) with registration at 2% capped at Rs 25,000, from an undated State e-registration PDF (Uttarakhand e-registration fee sheet); confirm the current rate and the circle rate with the Sub-Registrar. NRIs and OCIs are barred from buying agricultural land, plantations and farmhouses under FEMA; confirm the current RBI text.

๐ Distances (as reported)
๐ฃ Rail, air and the road reality
Kotdwar has a British-era railway station, and a newspaper report of 27 February 2024 says its redevelopment foundation stone was laid on 26 February 2024. We did not read train schedules, so check which services run before you plan around rail.
A four-lane bypass on NH-119 has been put out to tender by NHAI; until it is built, town traffic remains a factor.

Why buyers look at Kotdwar
Reasons are few; each has a catch, and this is a tier C page.
Plains-edge access
Delhi is about 216 km, Haridwar 70 km and Dehradun 116 km (approximate). The catch: these distances are not route-checked.
A rail town
Kotdwar has a long-standing station that is being redeveloped. The catch: no completion date or train list was found.
A second Corbett gate
A Corbett entry was reported opened from this side in 2017. The catch: it may mean buffer-zone and ESZ limits on nearby land.
Industrial base
Pharma, polymer and steel units are reported. The catch: no source ties this to land prices.
Risks & challenges specific to Kotdwar
Kotdwar-specific risks, beyond the Uttarakhand-wide points on the state and Pauri Garhwal pages.
Municipal boundary versus village land
Rules differ inside and outside corporation limits, and limits change. Get the boundary and land-use status in writing per khasra.
Corbett buffer and forest
Land near forest or the Corbett side may be inside eco-sensitive or buffer rules. Confirm with the Forest Department.
River and flood risk
The Khoh and Malini rivers are reported nearby; we read no flood data. Ask for the flood history of any parcel.
Unreliable population figure
Population figures for Kotdwar mix town and wider-area counts; use the Census of India 2011 town table, not a headline number, to size demand.
