Baran โ land purchase legal rules
In the Ceiling Act and the part of the Tenancy Act we read, no clause limits the purchase of agricultural land to farmers. The limits that do appear sit elsewhere: who may sell (Section 42), how much one family may hold, and how the land may be used once bought.
Who can buy agricultural land? We found no farmer-only clause in the Rajasthan Imposition of Ceiling on Agricultural Holding Act, 1973 or in the first 100,000 characters (of about 108,700) of the Tenancy Act, 1955, apart from the Section 42 bar described below. Clause (a) of Section 42 was omitted with effect from 11 November 1992. Whether any residency or farmer test applies to a particular parcel should be checked with the Sub-Registrar before an advance is paid.
Ceiling limits still apply: Section 4(1) of the Ceiling Act sets, for a family of up to five members, 18 acres of land under assured irrigation that can grow two crops a year and 27 acres where it can grow one crop. Unirrigated land is capped by zone: 48 acres in the fertile zone, 54 in the semi-fertile zone, 125 in the semi-desert zone and 175 in the desert zone (the hilly-zone figure is unclear in the printed text). The ceiling rises by one-fifth for each member beyond five, up to twice the base. Section 17(1) bars acquiring land that takes a holding past the ceiling, and Section 17(2) requires declarations from buyer and seller before the transfer document is registered. The India Code text records amendments up to 2020, so the current schedule needs checking.
SC/ST khatedar land, Section 42 of the Tenancy Act: under clause (b), a sale, gift or bequest of khatedari rights by a Scheduled Caste member to a person outside that community, or by a Scheduled Tribe member to a person outside that tribe, is void; clause (bb) adds the Saharia tribe (Tenancy Act). In State of Rajasthan v. Aanjaney Organic Herbal Pvt. Ltd., Civil Appeals 6741-6742 of 2012, the Supreme Court held on 20 September 2012 that a sale by an SC member to a company was void (Supreme Court, September 2012). In February 2025 the Rajasthan High Court held again that a non-SC/ST buyer cannot acquire khatedari rights by adverse possession (LiveLaw, February 2025). The seller's community should be read from the jamabandi before any money moves.
Conversion for non-agricultural use, Section 90A: Section 90A of the Rajasthan Land Revenue Act, 1956 requires permission before agricultural land is put to non-agricultural use, building included. The State Government decides after an inquiry, the holder pays urban assessment or a premium, and use without permission exposes the holder to ejectment under Section 91 or to a penalty (Indian Kanoon text of Section 90A; the India Code copy could not be opened). The Rajasthan High Court noted in February 2022 that the government may regularise unauthorised conversions (LiveLaw, February 2022). For rural land, the 2007 conversion rules name the deciding officer by use and size: the Tehsildar for a residential unit up to 2,500 sq m, the Sub-Divisional Officer, Collector or State Government for larger plots. A complete application is to be decided within 90 days, and the converted land used within five years (Rules 9(3) and 14(1), Revenue Department rules, 2019 compilation). Later amendments to the rules were not read.
NRI & OCI buyers: The Reserve Bank's Master Direction under FEMA 1999 lets NRIs and OCIs buy immovable property other than agricultural land, plantation property or a farm house, in Rajasthan as elsewhere (RBI Master Direction, updated to 1 September 2022). The inheritance clauses carry no such exclusion, and residential or commercial plots are not on the excluded list.

Baran โ district-specific notes
The Rajasthan state page applies to Baran in full. The notes below are specific to this district and are not repeated in full from the state page. Law was read from Act texts on India Code, a Supreme Court judgment, a draft Ministry of Environment notification and a district profile; where an official page did not open, the note says so.
โ Baran has a tribal-land angle. The district industrial profile records Sehariya settlements in Kishanganj, Shahbad, Atru and Mangrol tehsils (industrial profile), and clause (bb) of Section 42 of the Tenancy Act, 1955 brings the Saharia tribe within the sale bar. The profile's spelling differs from the Act's, so treat the match as likely, not proven, and read the khatedar's community from the jamabandi. Section 42 of the Tenancy Act, 1955 makes void a sale, gift or bequest of khatedari rights by a Scheduled Caste member to someone outside that community, or by a Scheduled Tribe member to someone outside that tribe; clause (bb) adds the Saharia tribe. The Supreme Court applied the bar to a company buyer in 2012, and the Rajasthan High Court held in February 2025 that adverse possession does not cure it. Read the seller's community from the jamabandi before any money moves.
โ Shergarh Wildlife Sanctuary lies in Atru tehsil on the Baran-Jhalawar border. A draft notification of 19 October 2015 proposes a 1 km eco-sensitive zone of about 58.06 sq km across 22 villages, 17 of them in Baran, with no new commercial construction or hotels inside it, no new or existing mining and quarrying, and agricultural land convertible only for listed local uses (MoEFCC draft S.O. 2868(E)). We did not find the final notification, so the draft is the only text we can describe. Ask the Divisional Forest Officer whether a village is in the zone.
โ Putting agricultural land to non-agricultural use needs permission under Section 90A of the Rajasthan Land Revenue Act, 1956 (Indian Kanoon text; the India Code copy could not be opened). For rural land, the 2007 conversion rules name the deciding officer by use and size, require a decision within 90 days of a complete application (Rule 9(3)) and use of the converted land within five years (Rule 14(1)). Later amendments to the rules were not read.
โ Ceiling limits still apply. Section 4(1) of the Ceiling Act, 1973 sets, for a family of up to five, 18 acres of land under assured irrigation that grows two crops a year and 27 acres where it grows one crop; unirrigated land is capped by zone at 48, 54, 125 or 175 acres. Section 17(2) requires declarations from buyer and seller before the deed is registered. The India Code text records amendments up to 2020, so the current schedule needs checking.
โ The Reserve Bank's Master Direction does not let NRIs and OCIs buy agricultural land, plantation land or a farm house; residential and commercial plots are not on the excluded list.

District overview
Baran โ an irrigated mustard-wheat district with forest on its edge
Baran is a district of 6,992 sq km with 12,22,755 people at Census 2011 (district profile, May 2018). It has eight tehsils (Baran, Anta, Atru, Mangrol, Chhabra, Chhipabarod, Kishanganj, Shahabad) and one nagar parishad in that profile. The industrial profile lists three RIICO industrial areas with 383 plots, 324 of them allotted in data that runs to 2011-12 (MSME industrial profile). Those figures are old and the profile itself is undated.
We publish no per-acre price band for Baran. No district rate series or registered-deal data could be traced, and listing-site asking prices cannot be linked to registered deals. The statewide DLC revisions are the only dated reference: up to 50% for irrigated rural land in December 2024 (Patrika, December 2024), about 10% in April 2026 and 5% to 49% in listed areas from 3 August 2026 (Patrika, August 2026). We found no Baran village list for the August revision.
Baran is farmland first. The 2023-24 agricultural statistics put net irrigated area at 97.05% of net sown area, with rapeseed-mustard on 23.76% and wheat on 18.81% of cropped area (Directorate of Economics and Statistics), and forest covers 2,18,630 hectares of the 6,99,461 hectare reporting area, about 31% by our arithmetic. Groundwater, forest status and the Shergarh eco-zone matter as much as the road.

The surcharge cap was raised from 10% to 20% by the Rajasthan Stamp (Amendment) Bill, 2018 (PRS, Bill 18 of 2018; The Tribune, September 2018). The rate notified today is not confirmed, and the base stamp duty and registration fee for a sale deed could not be traced, so none is quoted. Deeds are registered through the Registration and Stamps Department's ePanjiyan system (NeGD listing). DLC rates were raised by up to 50% for irrigated rural land in December 2024, with agricultural registration moving to hectares (Patrika, December 2024), by about 10% in April 2026 and by 5% to 49% in listed areas from 3 August 2026 (Patrika, August 2026). Since July 2024 Rule 57 of the Stamp Rules lets the registering officer inspect the land and value open land and structures separately (TeamLease RegTech, July 2024). We found no Baran village-level DLC list, so no district rate is quoted. Take the current schedule from the Sub-Registrar.

Statewide DLC revisions
Up to 50% (Dec 2024) ยท +10% (Apr 2026) ยท 5-49% in listed areas (3 Aug 2026)
DLC rates for irrigated rural land rose by up to 50% in December 2024 and agricultural registration moved to hectares (Patrika, December 2024). Rates rose about 10% in April 2026 and by 5% to 49% in listed areas from 3 August 2026 (Patrika, August 2026; the report is not in English). We did not find which Baran villages were listed.

Irrigated farmland
Net irrigated 97.05% of net sown area (2023-24)
Net sown area was 3,46,765 hectares and net irrigated area 3,36,531 hectares; gross cropped area was 6,65,042 hectares (Directorate of Economics and Statistics). The CGWB brochure (data to 2009) shows tubewells irrigating 1,91,558 hectares and canals 54,485 hectares (CGWB brochure).
Check: the source of irrigation for the parcel and the borewell yield.
Forest and sanctuary edge
Forest 2,18,630 ha of a 6,99,461 ha reporting area
About 31% of the reporting area is recorded as forest (Directorate of Economics and Statistics). Land near Shergarh sits inside a proposed eco-sensitive zone that would bar new commercial construction (draft S.O. 2868(E)).
Check: whether the khasra is forest, revenue or inside the eco-zone.
Units: acres and hectares
Rajasthan land is sold in local units that vary by district and tehsil, so convert every quote into acres or hectares and confirm the share of the khasra being sold. Agricultural registration in the state moved to hectares in December 2024 (Patrika, December 2024). Ask the patwari which local unit a seller means.

Soil, crops & water in Baran
Irrigated black and loamy soils, mustard and wheat on most cropped land, and a forested southern and eastern edge. Groundwater is stressed in two blocks on the 2009 figures.
๐พ Soils and crops
The CGWB brochure lists deep black clayey soil, deep brown loamy soil, red gravelly loam in the hilly southern and eastern parts, and black kachari soil mainly in Baran and Mangrol tehsils (CGWB brochure). In 2023-24 rapeseed-mustard took 23.76% of cropped area, wheat 18.81%, maize 6.38% and gram 3.92%; gross cropped area was 6,65,042 hectares against 3,46,765 hectares net sown, so land is sown about 1.9 times a year by our arithmetic (Directorate of Economics and Statistics).

๐ง Irrigation
Net irrigated area was 3,36,531 hectares in 2023-24, or 97.05% of net sown area (Directorate of Economics and Statistics). The CGWB brochure, with data to 2009, gives canal irrigation of 54,485 hectares, tubewells 1,91,558, other wells 28,252 and tanks 2,376 (CGWB brochure). The source mix has probably changed since, so ask which canal or well serves the parcel.

โฐ๏ธ Forest and hills
Forest covers 2,18,630 hectares of the 6,99,461 hectare reporting area (Directorate of Economics and Statistics). The southern and eastern parts carry red gravelly hilly soil (CGWB brochure), and Shergarh sanctuary sits on the Jhalawar border. Legal status matters more than soil near the forest edge.

๐ง Water & rainfall
The CGWB brochure puts normal annual rainfall at 852.7 mm (1951-2000) and the 2000-2011 average at 707 mm (CGWB brochure); the 2018 district profile gives an average of 824.31 mm for 2014-15 (district profile). On 31 March 2009 the district stage of groundwater development was 96.18%: Baran (146.01%) and Atru (122.46%) were over-exploited, Chhipabarod (98.43%) critical, Anta (88.91%) semi-critical, and Chhabra, Kishanganj and Shahbad safe (CGWB brochure). Those figures are 17 years old. CGWB's 2024 assessment puts the state at 149.86% extraction with 214 of 302 units over-exploited and lists Baran only for nitrate above 45 mg/L in sporadic samples (CGWB, 2024). We did not find a 2024 block table for Baran. Check the borewell yield and permission for any parcel.
๐ Measurement units
Rajasthan local land units vary by district and tehsil, so convert every quote to acres or hectares before comparing offers. Mandi prices are published on the national agricultural marketing portal, which was not opened for this page; crop income is modest next to land values, so price a parcel on its location, water and permitted use.

Farmland India view
Why investors look at Baran
Five reasoned points, with an honest note that the price evidence is thin and the catalysts are pending.
An irrigated base
Net irrigated area was 97.05% of net sown area in 2023-24 and gross cropped area ran about 1.9 times net sown area. The return case on farming is real, but it depends on a working water source.
Forest and sanctuary limits on supply
About 31% of the reporting area is forest, and a draft eco-zone would restrict construction and conversion near Shergarh. That narrows where a farmhouse or plot can lawfully go.
A named link project, not a built one
Baran is on the 21-district Lok Sabha list for the link canal, which was at DPR appraisal in December 2025. This desk reads it as optionality, not a basis for a premium.
Older industrial estates
Three RIICO areas had 324 of 383 plots allotted in data to 2011-12. That shows past take-up, not current demand.
A market that rewards paperwork
With tribal-land, eco-zone, groundwater and DLC questions all parcel-specific, a buyer who documents each one is better placed than one relying on a broker summary.
Confirm khatedar class, forest or eco-zone status and Section 90A conversion directly; these are not certified by Farmland India's review.
STRAIGHT TALK
Risks & challenges in Baran
Read these before shortlisting in Baran specifically.
Tribal-land sale bar
Section 42 voids a sale of khatedari land by an SC or ST member, including the Saharia tribe, to someone outside the community. The industrial profile records Sehariya settlements in four tehsils. Establish the seller's community before any advance.
Shergarh eco-zone
The 2015 draft would bar new commercial construction and all mining in a 1 km zone across 17 Baran villages. We did not find the final notification; ask the Forest Department.
Groundwater stress
On 2009 figures Baran and Atru blocks were over-exploited and Chhipabarod critical. Check borewell depth and any restriction before assuming irrigation.
Forest land
About 31% of the reporting area is forest. Ask whether a khasra is revenue land and whether any forest or sanctuary rule applies.
DLC-rate churn
DLC rates were revised in December 2024, April 2026 and on 3 August 2026. A valuation agreed in spring may not match the schedule in force at registration.
Announced is not delivered
The link canal was at DPR appraisal in December 2025 and the Sheopur-Kota rail route is only a request. Price on today's fundamentals.
No sourced price series
We use no listing-site prices for Baran, and DLC rates are only a floor. Collect registered comparables before negotiating.
Who to contact
Local revenue, planning & forest offices
Mutation and revenue-record matters go through the Tehsildar of the relevant tehsil (Baran, Anta, Atru, Mangrol, Chhabra, Chhipabarod, Kishanganj or Shahabad, per the 2018 district profile), under the District Collector. Sale-deed registration is handled by the Sub-Registrar under the ePanjiyan system, which feeds eDharti land records for agricultural deeds (NeGD listing). Conversion of rural agricultural land is decided by the Tehsildar, Sub-Divisional Officer, Collector or State Government depending on use and size (Rule 9, 2007 rules, 2019 compilation). The Divisional Forest Officer is the office to ask about forest land and the Shergarh eco-zone. The Revenue Department portal, ePanjiyan and the Baran district portal pages we opened carried no office detail, so take office locations and jurisdiction maps from the department directly.

COMMON QUESTIONS
Frequently asked questions
Everything buyers, NRIs and investors ask before their first reviewed farmland purchase in Baran.
Visit full wiki01 of 04
What does agricultural land cost in Baran?
We publish no per-acre band for Baran because no district rate series could be traced and listing-site asking prices cannot be linked to registered deals. The only dated reference points are statewide: DLC rates rose by up to 50% for irrigated rural land in December 2024 (Patrika), about 10% in April 2026 and 5% to 49% in listed areas from 3 August 2026 (Patrika, August 2026). We found no Baran village list, so check the village's DLC rate at the Sub-Registrar.
02 of 04
Are there special sale rules for tribal land in Baran?
Section 42 of the Rajasthan Tenancy Act, 1955 voids a sale of khatedari land by a Scheduled Caste member to a non-member, and by a Scheduled Tribe member to a non-member; clause (bb) adds the Saharia tribe. The district industrial profile records Sehariya settlements in Kishanganj, Shahbad, Atru and Mangrol tehsils, so read the seller's community from the jamabandi. We read no district-specific order.
03 of 04
What stamp duty applies to land in Baran?
Base stamp duty and registration fee rates: no official or news source reached, so we state none. Statewide, a surcharge of up to 20% on stamp duty for cow protection is set under the Rajasthan Stamp Act, 1998 (Tribune, September 2018), and DLC rates were revised in April and August 2026 (Patrika). Confirm the rate and the village DLC rate with the Sub-Registrar.
04 of 04
Which projects and restrictions affect Baran?
Baran is named among 21 districts for the Parbati-Kalisindh-Chambal link with ERCP, which was at DPR appraisal in December 2025. A draft 2015 notification proposes a 1 km eco-sensitive zone around Shergarh Wildlife Sanctuary across 17 Baran villages; we found no final notification. A Sheopur-Kota rail route via Baran has been requested in Parliament, with no sanction found.
