Jaisalmer — land purchase legal rules
In the Ceiling Act and the part of the Tenancy Act we read, no clause limits the purchase of agricultural land to farmers. The limits that do appear sit elsewhere: who may sell (Section 42), how much one family may hold, and how the land may be used once bought.
Who can buy agricultural land? We found no farmer-only clause in the Rajasthan Imposition of Ceiling on Agricultural Holding Act, 1973 or in the first 100,000 characters (of about 108,700) of the Tenancy Act, 1955, apart from the Section 42 bar described below. Clause (a) of Section 42 was omitted with effect from 11 November 1992. Whether any residency or farmer test applies to a particular parcel should be checked with the Sub-Registrar before an advance is paid.
Ceiling limits still apply: Section 4(1) of the Ceiling Act sets, for a family of up to five members, 18 acres of land under assured irrigation that can grow two crops a year and 27 acres where it can grow one crop. Unirrigated land is capped by zone: 48 acres in the fertile zone, 54 in the semi-fertile zone, 125 in the semi-desert zone and 175 in the desert zone (the hilly-zone figure is unclear in the printed text). The ceiling rises by one-fifth for each member beyond five, up to twice the base. Section 17(1) bars acquiring land that takes a holding past the ceiling, and Section 17(2) requires declarations from buyer and seller before the transfer document is registered. The India Code text records amendments up to 2020, so the current schedule needs checking.
SC/ST khatedar land, Section 42 of the Tenancy Act: under clause (b), a sale, gift or bequest of khatedari rights by a Scheduled Caste member to a person outside that community, or by a Scheduled Tribe member to a person outside that tribe, is void; clause (bb) adds the Saharia tribe (Tenancy Act). In State of Rajasthan v. Aanjaney Organic Herbal Pvt. Ltd., Civil Appeals 6741-6742 of 2012, the Supreme Court held on 20 September 2012 that a sale by an SC member to a company was void (Supreme Court, September 2012). In February 2025 the Rajasthan High Court held again that a non-SC/ST buyer cannot acquire khatedari rights by adverse possession (LiveLaw, February 2025). The seller's community should be read from the jamabandi before any money moves.
Conversion for non-agricultural use, Section 90A: Section 90A of the Rajasthan Land Revenue Act, 1956 requires permission before agricultural land is put to non-agricultural use, building included. The State Government decides after an inquiry, the holder pays urban assessment or a premium, and use without permission exposes the holder to ejectment under Section 91 or to a penalty (Indian Kanoon text of Section 90A; the India Code copy could not be opened). The Rajasthan High Court noted in February 2022 that the government may regularise unauthorised conversions (LiveLaw, February 2022). For rural land, the 2007 conversion rules name the deciding officer by use and size: the Tehsildar for a residential unit up to 2,500 sq m, the Sub-Divisional Officer, Collector or State Government for larger plots. A complete application is to be decided within 90 days, and the converted land used within five years (Rules 9(3) and 14(1), Revenue Department rules, 2019 compilation). Later amendments to the rules were not read.
NRI & OCI buyers: The Reserve Bank's Master Direction under FEMA 1999 lets NRIs and OCIs buy immovable property other than agricultural land, plantation property or a farm house, in Rajasthan as elsewhere (RBI Master Direction, updated to 1 September 2022). The inheritance clauses carry no such exclusion, and residential or commercial plots are not on the excluded list.

Jaisalmer — district-specific notes
The Rajasthan state page applies to Jaisalmer in full. The notes below are specific to this district. Law was read from Act texts on India Code, court reports and news; the district portal and the Revenue Department sites did not open for this review, and the note says so where it matters.
⚠ Jaisalmer is a border district. After the Union Home Minister ordered demolition of illegal structures within 50 km of the Pakistan border on a 26 May 2026 visit to Bikaner, the Income Tax Department's investigation wing visited the Jaisalmer Sub-Registrar's office on 14 July 2026, examined 2024-25 and 2025-26 registration records and seized 50 files (Free Press Journal, July 2026). The same report says the High Court dismissed challenges to the demolitions and told the state to set up a review committee of the District Collector, the Superintendent of Police and a BSF representative to assess sensitive structures case by case. The report describes no purchase restriction for buyers. Before paying an advance on a parcel near the border, ask the Collector's office in writing whether any border-belt condition applies and keep every payment traceable.
⚠ The Supreme Court's judgment of 19 December 2025 on the Great Indian Bustard fixed priority conservation areas covering 14,013 sq km in Rajasthan. Inside them the report lists no new wind turbines, no solar parks above 2 MW and no expansion of existing renewable projects, and it orders overhead lines to be moved or put underground (Down To Earth, December 2025). The report does not map the areas district by district, so a buyer planning energy use of a Jaisalmer parcel should ask the Forest Department whether the khasra falls inside one.
⚠ Section 42 of the Rajasthan Tenancy Act, 1955 makes a sale by a Scheduled Caste or Scheduled Tribe khatedar to a person outside that community void, and the Supreme Court applied the bar to a company buyer in 2012 (Supreme Court, September 2012). Read the seller's community from the jamabandi before any money moves.
⚠ Section 4(1) of the Ceiling Act, 1973 allows 18 acres of land under assured irrigation that grows two crops and 27 acres for one crop, and 125 or 175 acres of unirrigated land in the semi-desert and desert zones. Which zone a given Jaisalmer village sits in is a Revenue Department classification we did not find, and the India Code text records amendments to 2020, so ask for the current schedule. Canal-irrigated land in the Indira Gandhi canal belt will fall under the irrigated tiers; we found no purchase rule specific to canal command land.
⚠ Non-agricultural use needs Section 90A permission under the Rajasthan Land Revenue Act, 1956 (Indian Kanoon text); for rural land the 2007 conversion rules name the deciding officer by use and size and set a 90-day decision period (Revenue Department rules, 2019 compilation). Later amendments were not read. NRIs and OCIs may not buy agricultural land, plantation land or a farm house under the RBI Master Direction (RBI, updated September 2022).

District overview
Jaisalmer — a canal strip and a border desert
Jaisalmer covers 38,401 sq km and had 6,69,919 people at Census 2011 (CGWB, July 2017). The state is 3,42,239 sq km (Resident Commissioner profile), so on those two figures the district is roughly one-ninth of Rajasthan (our arithmetic). The CGWB report lists tehsils Jaisalmer, Pokaran, Bhiniyana and Fatehgarh and development blocks Jaisalmer, Sam and Sankra; the MSME-DI profile gives three tehsils and these are Census-era lists, so the current tehsil list should be taken from the district office. Jaisalmer was not among the districts annulled on 28 December 2024 (Scroll, December 2024).
We publish no per-acre price band for Jaisalmer. No registered-deal series or district DLC schedule was reachable, and listing-site asking prices could not be traced to deals. The statewide DLC revisions are the only official movement: about 10% in April 2026 and 5% to 49% in listed areas from 3 August 2026 (Patrika, August 2026; the report is in Hindi). A May 2026 Patrika report on repeated DLC rises names Jaipur, Jodhpur, Ajmer, Kota and Udaipur but not Jaisalmer (Patrika, May 2026).
Water decides the farming map. Of 3,42,262 hectares irrigated, 2,10,880 come from the Indira Gandhi canal and 1,29,732 from tubewells, and the canal share is about 61.6% (CGWB, July 2017). Normal rainfall is 184.34 mm a year, and all three blocks were classed over-exploited for groundwater as on 31 March 2013. Away from the canal, farming rests on tubewells that the same report shows heavily drawn down.

The surcharge cap was raised from 10% to 20% by the Rajasthan Stamp (Amendment) Bill, 2018, effective 13 June 2018 (PRS, Bill 18 of 2018; The Tribune, September 2018). The rate notified today is not confirmed, and we could not trace the base stamp duty or registration fee for a sale deed, so none is quoted for Jaisalmer. Deeds are registered through the Registration and Stamps Department's ePanjiyan system (NeGD listing). Patrika reported in August 2026 that duty and fee are based on DLC rates (Patrika, August 2026; the report is in Hindi). Its December 2024 example: on a Rs 50 lakh transaction in an area where the DLC rate rose 15%, the extra cost was Rs 66,000 in a man's name and Rs 56,250 in a woman's (Patrika, December 2024). Since July 2024, Rule 57 of the Stamp Rules lets the registering officer inspect the land and value open land and structures separately (TeamLease RegTech, July 2024). For Jaisalmer, no district DLC schedule was reachable. Take the current schedule from the Sub-Registrar.

What is moving prices in Jaisalmer
Statewide DLC revisions, one border-district report and no price series. No listing-site prices are used.
DLC rates: statewide revisions only
No Jaisalmer figure sourced
The state raised DLC rates about 10% in April 2026 and by 5% to 49% in listed areas from 3 August 2026 (Patrika, August 2026). In December 2024 irrigated rural land rose by up to 50% and agricultural registration moved to hectares (Patrika, December 2024). We did not reach a Jaisalmer village schedule.
Check: the rate in force for the village on the sale-deed date.
Registration scrutiny in a border district
Reported, July 2026
Income Tax officials examined Jaisalmer registrations for 2024-25 and 2025-26 and seized 50 files, according to Free Press Journal, July 2026. The report concerns cash transactions and suspicious funding, not ordinary buyers, but it points to closer reading of deeds.
Check: that the consideration in the deed matches the money paid, by bank transfer.
Solar and wind land
Allocation approved, Sep 2025
The state approved land for solar parks of 26,400 MW in Jaisalmer and 5,200 MW in Bikaner, according to The Week, September 2025. The report gives capacity, not hectares. The Supreme Court's December 2025 bustard order restricts new wind and larger solar projects inside priority areas (Down To Earth, December 2025).
Check: whether the khasra is in a priority area before paying for energy use.
Asking prices
No sourced price series
No Jaisalmer asking-price series could be traced to registered deals, so none is shown. A DLC rate is a registration floor, not what a seller will accept.
Check: registered sale deeds in the same revenue estate before negotiating.
Units: acre, hectare and local measures
Land in Jaisalmer is priced in acres or hectares in this guide. Local units differ between tehsils and between sellers and the revenue record, so ask for the khasra area in hectares and convert any quote before comparing two offers. We opened no revenue manual for local unit definitions.

🌾 Canal-irrigated belt (Jaisalmer and Sam blocks)
The CGWB report credits the Indira Gandhi canal with 1,49,996 hectares in Jaisalmer block and 60,884 hectares in Sam block. Its crop table (year not given, layout hard to read) lists gwar, gram, cumin, mustard and groundnut, with gram the largest irrigated rabi crop at 1,27,983 hectares and cumin at 38,940 hectares (CGWB, July 2017).

🏜️ Tubewell belt (Sankra block)
Sankra block shows no canal area and 53,963 hectares irrigated from groundwater, and its stage of groundwater development was 331.66% as on 31 March 2013 (CGWB, July 2017). Farming here depends on pumping from an over-exploited aquifer.

🦅 Desert National Park and bustard habitat
The Supreme Court's December 2025 order protects 14,013 sq km of priority areas in Rajasthan and routes new power evacuation through one corridor up to 5 km wide south of Desert National Park (Down To Earth, December 2025). Legal status matters more than soil for any parcel near the park.
- Desert National Park
- Priority areas
💧 Water & rainfall
Normal annual rainfall is 184.34 mm (1901-2006 average, CGWB, July 2017). The same report puts the stage of groundwater development at 332.71% in Jaisalmer block, 125.33% in Sam and 331.66% in Sankra as on 31 March 2013, all over-exploited; the canal supplies about 61.6% of irrigation and groundwater about 38.4%. CGWB's 2024 state assessment gives no Jaisalmer extraction figure but flags sporadic excess salinity, fluoride, nitrate and uranium in Jaisalmer samples, and puts the state at 149.86% extraction with 214 of 302 units over-exploited (CGWB, 2024). Check borewell depth, yield and water quality on site.
📐 Measurement units
Use acres or hectares to compare offers. Local measures differ by tehsil and we opened no revenue manual, so ask the patwari for the khasra area in hectares. Mandi prices for gwar, cumin and mustard are published by the Directorate of Marketing and Inspection; we did not open that portal and quote no price. Crop income is modest next to the cost of canal-fed land, so price a parcel on water access and permitted use.

Farmland India view
Why investors look at Jaisalmer
Five reasoned points, with an honest note that the price evidence is thin and several catalysts are still proposals.
A border district that is also a canal district
The Indira Gandhi canal irrigates 2,10,880 hectares in the district, which makes it more than desert. Border-belt conditions still apply to some parcels, so the location of the khasra decides the case.
Large energy allocations, with a court limit
The state approved solar park land of 26,400 MW in Jaisalmer, while the Supreme Court's December 2025 bustard order restricts new projects in priority areas. Land priced on energy hopes carries both facts.
Rail and road proposals
The Jaisalmer–Barmer highway was approved in March 2025 and two new rail lines were at survey stage in March 2026. These are proposals; price on today's access.
Thin price evidence
No district DLC schedule or deal series was reachable. A buyer should collect registered comparables in the same revenue estate rather than rely on asking prices.
Paperwork decides the outcome
Section 42, the ceiling tiers, Section 90A and border-belt checks are all parcel-specific. A buyer who documents each one is better placed than one relying on a broker summary.
Confirm khatedar class, Section 90A status and any border-belt condition directly; these are not certified by Farmland India’s review.
STRAIGHT TALK
Risks & challenges in Jaisalmer
Read these before shortlisting in Jaisalmer specifically.
Border-belt scrutiny
Illegal structures within 50 km of the border were ordered demolished in 2026 and Jaisalmer registrations were examined in July 2026. Ask in writing about any condition on the parcel and keep payments traceable.
Bustard priority areas
The December 2025 Supreme Court order limits new wind and solar projects and moves overhead lines in priority areas. Ask whether the khasra lies inside one.
Over-exploited groundwater
All three blocks were over-exploited as on 31 March 2013, with Jaisalmer and Sankra above 330%. Check borewell depth and water quality before assuming irrigation.
Canal dependence
About 61.6% of irrigation is canal water. A parcel outside the command area depends on tubewells; ask for the canal outlet and water rights in writing.
Section 42 exposure
A sale by an SC or ST khatedar to someone outside that community is void under Section 42. Read the community from the jamabandi before an advance.
Fast-moving DLC rates
Rates were revised in April and August 2026. A valuation agreed in spring may not match the schedule in force at registration.
Announced is not delivered
The highway is approved, the rail lines are at survey stage and the solar allocation has no hectares stated. Price on today's fundamentals.
No sourced price series
We use no listing-site prices for Jaisalmer. Collect registered comparables before negotiating.
Who to contact
Local revenue & registration offices
Conversion of rural agricultural land is decided by the Tehsildar, Sub-Divisional Officer, Collector or State Government, depending on use and plot size (Rule 9, Revenue Department rules, 2019 compilation). Mutation and revenue-record matters go through the Tehsildar of the relevant tehsil. Sale-deed registration is handled by the Sub-Registrar, Jaisalmer, under the ePanjiyan system, which feeds the eDharti land records for agricultural deeds (NeGD listing). The District Collector's office decides border-belt and conversion questions that reach the district. We could not open the Jaisalmer district portal or the Revenue Department and ePanjiyan sites, so take office locations and jurisdiction from the department directly.

What does agricultural land cost in Jaisalmer?
We publish no per-acre band for Jaisalmer. No district DLC schedule or registered-deal series was reachable, and listing-site asking prices could not be traced to deals. The state raised DLC rates about 10% in April 2026 and by 5% to 49% in listed areas from 3 August 2026 (Patrika, August 2026), but the report does not give Jaisalmer village figures. A DLC rate is a registration floor, not a market price.
02 of 04
Are there border-area rules for buying land in Jaisalmer?
Jaisalmer is a border district. In 2026 the Union Home Minister ordered demolition of illegal structures within 50 km of the border, the High Court asked for a review committee of the Collector, the Superintendent of Police and a BSF representative, and Income Tax officials examined Jaisalmer registrations in July 2026 (Free Press Journal, July 2026). The report describes no purchase restriction. Ask the Collector's office in writing whether any condition applies to your khasra.
03 of 04
What stamp duty applies to land in Jaisalmer?
We could not trace the base stamp duty or registration fee for a sale deed. The state adds a cow-protection surcharge of up to 20% on duty (Rajasthan Stamp (Amendment) Bill, 2018), and Patrika reported in August 2026 that duty and fee follow DLC rates. Take the current schedule from the Sub-Registrar.
04 of 04
Which projects affect Jaisalmer land?
The Jaisalmer–Barmer highway upgrade of about Rs 1,238 crore was approved in March 2025, final location surveys for two new rail lines were under way in March 2026, and a Jaisalmer–Delhi train was flagged off in late 2025. Solar park land of 26,400 MW was approved in September 2025, though the Supreme Court's December 2025 bustard order limits new projects in priority areas.
