Barmer โ land purchase legal rules
In the Ceiling Act and the part of the Tenancy Act we read, no clause limits the purchase of agricultural land to farmers. The limits that do appear sit elsewhere: who may sell (Section 42), how much one family may hold, and how the land may be used once bought.
Who can buy agricultural land? We found no farmer-only clause in the Rajasthan Imposition of Ceiling on Agricultural Holding Act, 1973 or in the first 100,000 characters (of about 108,700) of the Tenancy Act, 1955, apart from the Section 42 bar described below. Clause (a) of Section 42 was omitted with effect from 11 November 1992. Whether any residency or farmer test applies to a particular parcel should be checked with the Sub-Registrar before an advance is paid.
Ceiling limits still apply: Section 4(1) of the Ceiling Act sets, for a family of up to five members, 18 acres of land under assured irrigation that can grow two crops a year and 27 acres where it can grow one crop. Unirrigated land is capped by zone: 48 acres in the fertile zone, 54 in the semi-fertile zone, 125 in the semi-desert zone and 175 in the desert zone (the hilly-zone figure is unclear in the printed text). The ceiling rises by one-fifth for each member beyond five, up to twice the base. Section 17(1) bars acquiring land that takes a holding past the ceiling, and Section 17(2) requires declarations from buyer and seller before the transfer document is registered. The India Code text records amendments up to 2020, so the current schedule needs checking.
SC/ST khatedar land, Section 42 of the Tenancy Act: under clause (b), a sale, gift or bequest of khatedari rights by a Scheduled Caste member to a person outside that community, or by a Scheduled Tribe member to a person outside that tribe, is void; clause (bb) adds the Saharia tribe (Tenancy Act). In State of Rajasthan v. Aanjaney Organic Herbal Pvt. Ltd., Civil Appeals 6741-6742 of 2012, the Supreme Court held on 20 September 2012 that a sale by an SC member to a company was void (Supreme Court, September 2012). In February 2025 the Rajasthan High Court held again that a non-SC/ST buyer cannot acquire khatedari rights by adverse possession (LiveLaw, February 2025). The seller's community should be read from the jamabandi before any money moves.
Conversion for non-agricultural use, Section 90A: Section 90A of the Rajasthan Land Revenue Act, 1956 requires permission before agricultural land is put to non-agricultural use, building included. The State Government decides after an inquiry, the holder pays urban assessment or a premium, and use without permission exposes the holder to ejectment under Section 91 or to a penalty (Indian Kanoon text of Section 90A; the India Code copy could not be opened). The Rajasthan High Court noted in February 2022 that the government may regularise unauthorised conversions (LiveLaw, February 2022). For rural land, the 2007 conversion rules name the deciding officer by use and size: the Tehsildar for a residential unit up to 2,500 sq m, the Sub-Divisional Officer, Collector or State Government for larger plots. A complete application is to be decided within 90 days, and the converted land used within five years (Rules 9(3) and 14(1), Revenue Department rules, 2019 compilation). Later amendments to the rules were not read.
NRI & OCI buyers: The Reserve Bank's Master Direction under FEMA 1999 lets NRIs and OCIs buy immovable property other than agricultural land, plantation property or a farm house, in Rajasthan as elsewhere (RBI Master Direction, updated to 1 September 2022). The inheritance clauses carry no such exclusion, and residential or commercial plots are not on the excluded list.

Barmer โ district-specific notes
The Rajasthan state page applies to Barmer in full. The notes below are specific to this district and are not repeated in full from the state page. Law was read from Act texts on India Code, a Supreme Court judgment and news reports; no Barmer-specific order, border-area rule or mining-lease list was found, and the notes say so.
โ Barmer lost territory in the 2023 reorganisation, when Balotra became a district of its own, and Balotra was among the districts kept in December 2024 (Patrika, January 2025; Scroll, December 2024). Older papers, including the industrial survey, describe a larger Barmer that includes Balotra. Check which district and which Sub-Registrar office a village now falls under before relying on any older record.
โ Barmer is a border district. A March 2026 report names Barmer among the Rajasthan districts bordering Pakistan for new defence-linked rail lines (Patrika, March 2026), and a December 2022 report says the district headquarters hosts several military bases (PSU Connect, December 2022). We found no sourced rule that limits a private purchase in a border or defence-adjacent village, and no Barmer notification. Ask the Collector's office in writing whether any restriction applies to the khasra before paying a deposit.
โ Minerals matter here. The industrial survey lists gypsum, bentonite, granite, silica sand, lignite and other minerals, and mentions a large onshore oil field (MSME survey). We found no list of mining or petroleum leases by village, so ask the Mines Department whether a lease or prospecting licence covers the land.
โ Ceiling limits still apply. Section 4(1) of the Ceiling Act, 1973 sets, for a family of up to five, 18 acres of land under assured irrigation that grows two crops a year and 27 acres where it grows one crop; unirrigated land is capped by zone at 48, 54, 125 or 175 acres; which zone a Barmer village falls in is set by the Act's schedule, which we did not read. Section 17(2) requires declarations from buyer and seller before the deed is registered. The India Code text records amendments up to 2020, so the current schedule needs checking.
โ Section 42 of the Tenancy Act, 1955 makes void a sale, gift or bequest of khatedari rights by a Scheduled Caste member to someone outside that community, or by a Scheduled Tribe member to someone outside that tribe; clause (bb) adds the Saharia tribe. The Supreme Court applied the bar to a company buyer in 2012, and the Rajasthan High Court held in February 2025 that adverse possession does not cure it. Read the seller's community from the jamabandi before any money moves.
โ Putting agricultural land to non-agricultural use needs permission under Section 90A of the Rajasthan Land Revenue Act, 1956 (Indian Kanoon text; the India Code copy could not be opened). For rural land, the 2007 conversion rules name the deciding officer by use and size, require a decision within 90 days of a complete application (Rule 9(3)) and use of the converted land within five years (Rule 14(1)). Later amendments to the rules were not read.
โ The Reserve Bank's Master Direction does not let NRIs and OCIs buy agricultural land, plantation land or a farm house; residential and commercial plots are not on the excluded list.

District overview
Barmer โ a dryland border district beside a new refinery
Barmer is a western Rajasthan district with 18,79,225 hectares of reporting area in 2023-24, which is about 18,792 sq km (Directorate of Economics and Statistics). The 2023 reorganisation separated Balotra, so older documents describe a bigger district: the MSME survey gives 28,387 sq km and 26,04,453 people, with 8 tehsils, 341 km of railway and 7,494 km of roads (MSME survey, data to 2012). Barmer now has 12 panchayat samitis and 422 gram panchayats, Balotra nine and 266 (Patrika, January 2025).
We publish no per-acre price band for Barmer. No district rate series or registered-deal data could be traced, and listing-site asking prices cannot be linked to registered deals. The statewide DLC revisions are the only dated reference: up to 50% for irrigated rural land in December 2024 (Patrika, December 2024), about 10% in April 2026 and 5% to 49% in listed areas from 3 August 2026 (Patrika, August 2026). We found no Barmer village list for the August revision.
Barmer is dryland first. Net irrigated area was 27.71% of net sown area in 2023-24, and bajra took 44.86% of cropped area (Directorate of Economics and Statistics). The older survey gives average rainfall of 277 mm a year. The big new fact is next door: a refinery complex at Pachpadra, in Balotra district, was reported inaugurated on 4 July 2026 (Indian Infrastructure, July 2026). The same reports place the plant in Balotra, not Barmer.

The surcharge cap was raised from 10% to 20% by the Rajasthan Stamp (Amendment) Bill, 2018 (PRS, Bill 18 of 2018; The Tribune, September 2018). The rate notified today is not confirmed, and the base stamp duty and registration fee for a sale deed could not be traced, so none is quoted. Deeds are registered through the Registration and Stamps Department's ePanjiyan system (NeGD listing). DLC rates were raised by up to 50% for irrigated rural land in December 2024, with agricultural registration moving to hectares (Patrika, December 2024), by about 10% in April 2026 and by 5% to 49% in listed areas from 3 August 2026 (Patrika, August 2026). Since July 2024 Rule 57 of the Stamp Rules lets the registering officer inspect the land and value open land and structures separately (TeamLease RegTech, July 2024). We found no Barmer village-level DLC list, so no district rate is quoted. Take the current schedule from the Sub-Registrar.

Statewide DLC revisions
Up to 50% (Dec 2024) ยท +10% (Apr 2026) ยท 5-49% in listed areas (3 Aug 2026)
DLC rates for irrigated rural land rose by up to 50% in December 2024 and agricultural registration moved to hectares (Patrika, December 2024). Rates rose about 10% in April 2026 and by 5% to 49% in listed areas from 3 August 2026 (Patrika, August 2026; the report is not in English). We did not find which Barmer villages were listed.
Check: the DLC rate for the village in force on the deed date.
Asking prices
No sourced price series
Listing-site asking prices for Barmer could not be traced to registered deals, so none are shown. The DLC rate is a registration floor, not what a seller will accept.
Check: registered sale deeds in the same revenue estate before negotiating.
Dryland farming
Net irrigated 27.71% of net sown area (2023-24)
Net sown area was 11,70,281 hectares, net irrigated area 3,24,285 hectares and gross cropped area 14,99,207 hectares; bajra took 44.86% of cropped area (Directorate of Economics and Statistics). A parcel without a water source is a rain-fed bajra field.
Check: the water source, and whether the land is irrigated in the record.
Border and mineral land
No sourced rule or lease list
The district sits on the border and holds gypsum, lignite and other minerals (MSME survey; Patrika, March 2026). We found no village-level restriction or lease list, so none is described.
Check: with the Collector's office and the Mines Department for the specific khasra.
Units: acres and hectares
Rajasthan land is sold in local units that vary by district and tehsil, so convert every quote into acres or hectares and confirm the share of the khasra being sold. Agricultural registration in the state moved to hectares in December 2024 (Patrika, December 2024). Ask the patwari which local unit a seller means.
Connectivity

๐ง Irrigation
Net irrigated area was 3,24,285 hectares in 2023-24, or 27.71% of net sown area (Directorate of Economics and Statistics). The older survey leaves its irrigation table blank. ๐ง Water & rainfall
The older survey gives average rainfall of 277 mm a year (MSME survey). IMD's June-September normal for west Rajasthan is 283.6 mm, against 435.6 mm for the state (IMD Jaipur, 2025). CGWB's 2024 report lists Barmer among districts with sporadic samples above limits for electrical conductivity, fluoride, nitrate and uranium (CGWB, 2024); it gives statewide extraction of 149.86% with 214 of 302 units over-exploited and no Barmer unit table that we could read. Test the borewell water for the parcel and check yield and permission.
๐ Measurement units
Rajasthan local land units vary by district and tehsil, so convert every quote to acres or hectares before comparing offers. Mandi prices are published on the national agricultural marketing portal, which was not opened for this page; price a parcel on its water, access and permitted use rather than on bajra yield.

Farmland India view
Why investors look at Barmer
Five reasoned points, with an honest note that the price evidence is thin and the catalysts are pending.
A refinery next door
A large refinery complex was reported inaugurated at Pachpadra in Balotra in July 2026. It is a regional anchor, but we found no sourced effect on Barmer land and the plant is not in Barmer.
Border infrastructure in the pipeline
A Rs 1,237.71 crore highway project and a Rs 235.15 crore road upgrade were approved, and a 380 km rail line is at survey. None is shown as complete, so price on today's roads.
Large reporting area, little irrigation
Barmer has about 18,792 sq km of reporting area but only 27.71% of net sown land is irrigated. Water is the scarce input and the one to verify.
Minerals and oil beneath
Gypsum, lignite and an onshore oil field are listed in the older survey. They add upside for some areas and lease risk for others.
A market that rewards paperwork
With district-boundary, border, lease and DLC questions all parcel-specific, a buyer who documents each one is better placed than one relying on a broker summary.
Confirm khatedar class, border or lease status and Section 90A conversion directly; these are not certified by Farmland India's review.
STRAIGHT TALK
Risks & challenges in Barmer
Read these before shortlisting in Barmer specifically.
District-boundary confusion
Balotra was separated from Barmer in the 2023 reorganisation. Older documents describe the larger district, so check which district and Sub-Registrar office a village falls under.
Border and defence land
Barmer borders Pakistan and its headquarters hosts military bases. We found no sourced purchase rule, so ask the Collector's office in writing about any restriction.
Mining and petroleum leases
Gypsum, lignite, bentonite and oil are recorded in the district. Ask whether a lease or licence covers the khasra.
Water quality and supply
Barmer is listed for sporadic fluoride, nitrate, uranium and salinity exceedances. Test the water and check the borewell yield before assuming irrigation or a farmhouse supply.
Tribal-land sale bar
Section 42 voids a sale of khatedari land by an SC or ST member, including the Saharia tribe, to someone outside the community. Establish the seller's community before any advance.
Announced is not delivered
The border highway and rail projects were approved or at survey stage when reported. Price on today's fundamentals.
No sourced price series
We use no listing-site prices for Barmer, and DLC rates are only a floor. Collect registered comparables before negotiating.
Who to contact
Local revenue, planning & forest offices
Mutation and revenue-record matters go through the Tehsildar of the relevant tehsil, under the District Collector; the current Barmer tehsil list was not sourced, so confirm which tehsil a village falls under. Sale-deed registration is handled by the Sub-Registrar under the ePanjiyan system, which feeds eDharti land records for agricultural deeds (NeGD listing). Conversion of rural agricultural land is decided by the Tehsildar, Sub-Divisional Officer, Collector or State Government depending on use and size (Rule 9, 2007 rules, 2019 compilation). The Mines Department is the office to ask about mineral leases. The Revenue Department portal, ePanjiyan and the Barmer district portal page we opened carried no office detail, so take office locations and jurisdiction maps from the department directly.

COMMON QUESTIONS
Frequently asked questions
Everything buyers, NRIs and investors ask before their first reviewed farmland purchase in Barmer.
Visit full wiki01 of 04
What does agricultural land cost in Barmer?
We publish no per-acre band for Barmer because no district rate series could be traced and listing-site asking prices cannot be linked to registered deals. The only dated reference points are statewide: DLC rates rose by up to 50% for irrigated rural land in December 2024 (Patrika), about 10% in April 2026 and 5% to 49% in listed areas from 3 August 2026 (Patrika, August 2026). We found no Barmer village list, so check the village's DLC rate at the Sub-Registrar.
02 of 04
Is the Pachpadra refinery in Barmer?
No. Indian Infrastructure reported on 6 July 2026 that the refinery-cum-petrochemical complex at Pachpadra, inaugurated on 4 July 2026, is in Balotra district, which was separated from Barmer in the 2023 reorganisation. The reports we read do not mention Barmer and give no effect on Barmer land values.
03 of 04
What stamp duty applies to land in Barmer?
Base stamp duty and registration fee rates: no official or news source reached, so we state none. Statewide, a surcharge of up to 20% on stamp duty for cow protection is set under the Rajasthan Stamp Act, 1998 (Tribune, September 2018), and DLC rates were revised in April and August 2026 (Patrika). Confirm the rate and the village DLC rate with the Sub-Registrar.
04 of 04
Which road and rail projects affect Barmer?
A 134.86 km two-lane NH-70 and NH-11 project covering Barmer and Jaisalmer was approved at Rs 1,237.71 crore in March 2025, and a Rs 235.15 crore Ghagaria-Munabao upgrade was approved in December 2022 (NBM&CW). A 380 km Jaisalmer-Bhabhar/Bhildi rail line via Barmer was at final location survey in March 2026 (Patrika). We found no report that any is complete.
