Land law is state law. These rules are maintained on the Uttar Pradesh page and apply to every district within it.
Basti โ land purchase legal rules
โ Two checks come before any advance in Uttar Pradesh: the Revenue Code limit of 5.0586 hectares (about 12.5 acres) on what one person can acquire by purchase or gift, and the registry position in the DNGIR villages near Noida, where a purchase halt was reported in January 2024 and no later word was found. UP Revenue Code 2006, section 89; Sakshi Post, January 2024.
Who can buy agricultural land? The Revenue Code sections we read set a size limit (section 89) and special rules for land held by Scheduled Caste and Scheduled Tribe members (sections 98 and 99). None asks the buyer to be a farmer or to live in the state (UP Revenue Code 2006, IGRS UP). We did not read the whole tenure chapter, so ask the Sub-Registrar whether anything further applies. The Code repealed the Zamindari Abolition and Land Reforms Act 1950 when it was enforced on 18 December 2015 (SCC Online, February 2016).
Holding limit: section 89(2) of the Code bars a purchase or gift that would take the buyer's total holding in Uttar Pradesh above 5.0586 hectares, about 12.5 acres on our conversion (UP Revenue Code 2006). Under the earlier Act the Supreme Court read a company as a person for this limit and let the excess vest in the State (Oswal Fats and Oils, April 2010). The separate 1960 Ceiling Act caps total holdings; the India Code text gives 7.30 hectares of irrigated land for a family of five or fewer, with additions for larger families, and the text mixes acres and hectares, so the current schedule needs checking (India Code).
DNGIR villages: the Dadri-Noida-Ghaziabad Investment Region covers 84 notified villages, 63 in Bulandshahr and 21 in Gautam Buddh Nagar, notified in October 2024 (Swarajya, July 2026). In January 2024 a Noida Authority letter to the Stamp Department halted purchase and sale in the proposed villages, with registration of agricultural land needing the Authority's consent (Sakshi Post, January 2024). Two July 2026 reports on acquisition by mutual consent do not mention the halt (Millennium Post, July 2026), so ask the Noida Authority or the District Magistrate's office whether it still applies to a given village.
Scheduled Caste and Scheduled Tribe land: a Scheduled Caste bhumidhar needs the Collector's previous written permission to transfer land to a non-Scheduled Caste buyer (section 98), and a Scheduled Tribe bhumidhar may not transfer to a non-Scheduled Tribe buyer (section 99) (UP Revenue Code 2006). The Allahabad High Court described a transfer without the permission as void in Omwati v District Collector, Pilibhit, November 2022.
NRI & OCI buyers: the Reserve Bank's Master Direction under FEMA 1999 excludes agricultural land, plantation land and a farm house from what NRIs and OCIs may buy or receive as a gift (paragraphs 3.1.1 and 3.1.2). Inheritance is covered separately in paragraphs 3.1.3 and 3.1.4, without that exclusion (Reserve Bank of India Master Direction FED 12/2015-16).

Basti โ district-specific notes
The full Uttar Pradesh legal framework on the state page (ceiling, stamp duty, SC/ST land, NRI rules) applies to Basti in full. The notes below are specific to this district and are not repeated from the state page.
โ The conversion rule changed in 2026. The state cabinet cleared an ordinance amending section 80 of the UP Revenue Code in March 2026 (Free Press Journal, March 2026). Ordinance No. 14 of 2026 treats a building, development or layout approval inside a notified development-authority or industrial-authority area as the section 80(2) declaration, with the entry recorded in the revenue records within 15 days (PRS, Ordinance 14 of 2026), and a compliance bulletin reports it notified as an Act on 13 August 2026 (TeamLease RegTech, August 2026). Outside such areas the section 80 route through the Sub-Divisional Officer applies, with a 45 working-day decision period (UP Revenue Code text, India Code). Which regime covers your village is a question for the tehsil.
โ Basti lies north of the Ghaghara, which forms its southern boundary, and the Kuwano with its tributaries and the Rapti drain the district. The CGWB profile says the Ghaghra overflows its banks in the monsoon and submerges adjoining areas, and that its channel shifts in floods, moving land between banks (CGWB Basti profile). We found no flood-hazard map. A parcel in the Ghaghara or Kuwano floodplain should be checked with the district administration and priced for that risk.
โ The CGWB profile records arsenic above 50 ppb in 12 of 3,104 samples tested by UP Jal Nigam, 10 of them in Bahadurpur and 2 in Vikramjot, with arsenic reported in six blocks mainly along the Ghaghra (CGWB Basti profile). The CGWB 2024 state report lists Basti for arsenic above 10 ppb (CGWB, December 2024). Before buying land with a farmhouse in mind, ask which block the village falls in and have the borewell water tested.

District overview
Basti โ a Ghaghara-plain district in eastern UP
Basti is a district of eastern Uttar Pradesh with 2,688 sq km, four tehsils and 14 blocks (CGWB Basti profile). The district industrial profile gives about 22.9 lakh people for 2011, 74 km of national highway and 54 km of rail line, and names the Ghaghara, Manorama and Kuwano among its rivers (district industrial profile); its population table may differ from the Census, so confirm. The buyer here is likely to be a regional family looking for ordinary farmland or a modest parcel, not a corridor speculator, and the market is very different from the Jewar story on the Uttar Pradesh page.
The CGWB profile gives a net sown area of 2,090 sq km in 2010-11, of which 68.89% was irrigated. The industrial profile lists sugarcane, oilseeds, cotton, paddy and wheat as the main crops and names two sugar mills, Basti Sugar Mill and Govind Nagar Sugar Mill. Soils are clay, loam and sand, generally calcareous, with sand along the high banks of the Ghaghra (CGWB).
Roads are the only documented project. Land acquisition for widening NH-227B, the 84 Kosi Parikrama Marg, was notified at Harraiya in March 2025 (Gazette of India, March 2025), and the Gorakhpur Link Expressway runs nearby but not through the district (The Week, June 2025). We found no sourced per-acre price series, so this page quotes none. Anyone shortlisting here should gather registered sale deeds for the exact village.

What is moving prices in Basti
Reported figures with the source of each named. Listing-site asking prices are not used.
Why there is no price table
Asking prices from listing sites were removed from this page because they cannot be traced to registered deals. We found no registered-rate, collector-rate or news series for farmland in Basti, and we have not borrowed prices from neighbouring districts. Land here is shaped by flood risk, cane demand and distance in ways that differ from Ayodhya or Gorakhpur.
Circle rates
The government circle rate is the stamp-duty floor and the best public benchmark. District magistrates set rates each year (PTI via The Week, March 2025); that report did not name Basti among districts where revision was ongoing or due, and said 37 others had finished without naming them. We did not open the Basti rate table, so no figure is given. Ask the Sub-Registrar for the mauza rate and compare it with recent registered deeds.
NH-227B widening
A Section 3D notification of 27 March 2025 declares land to be acquired for widening Package-VI of the 84 Kosi Parikrama Marg on NH-227B, km 160.200 to 224.040, and lists Haidarabad village in Harraiya tehsil of Basti (Gazette of India, March 2025). We found no compensation rate or price movement.
Gorakhpur Link Expressway
The 91.35 km road costs Rs 7,283.28 crore including land acquisition and runs from Jaitpur in Gorakhpur to Salarpur in Azamgarh through Gorakhpur, Sant Kabir Nagar, Ambedkar Nagar and Azamgarh (The Week, June 2025). Basti is not among the districts named. We found no price effect on Basti land.
Water and soil shape value
The CGWB profile gives 68.89% of net sown area irrigated and pre-monsoon water 2.75 to 5.67 m below ground in 2012 (CGWB Basti profile), so irrigation is rarely the limit. The limits are flooding and arsenic, which differ from village to village.
Units
UP land is quoted in several local units whose size differs from district to district, so this page quotes only in acres and square yards. Always ask for the area in hectares or acres from the khatauni.
Connectivity
How Basti connects โ road, rail, air and expressways
Basti has 74 km of national highway and 54 km of rail line in the older industrial profile. No surveyed distances to Lucknow, Gorakhpur or Ayodhya were sourced, so check live routes. Journey times vary with traffic.

๐ฃ Gorakhpur Link Expressway, beside Basti
The 91.35 km Gorakhpur Link Expressway runs from Jaitpur in Gorakhpur to Salarpur in Azamgarh via Sant Kabir Nagar and Ambedkar Nagar, and The Week reported it due for inauguration on 20 June 2025 (The Week, June 2025). It passes beside Basti rather than through it, so Basti buyers use the highway and the rail line. Check the exact access road to any parcel. See the Uttar Pradesh land-rules guide for the rules that apply to a parcel along any of these roads.

NH-227B widening (84 Kosi Parikrama Marg)
The Ministry of Road Transport and Highways notified on 27 March 2025 under Section 3D of the National Highways Act that land at Haidarabad village, Harraiya tehsil, Basti district, would be acquired for Package-VI between km 160.200 and 224.040 (Gazette of India, March 2025). No cost or completion date was in the notice.
Gorakhpur Link Expressway
A 91.35 km, four-lane access-controlled expressway expandable to six lanes, costing Rs 7,283.28 crore, from Jaitpur in Gorakhpur to Salarpur in Azamgarh, where it joins the Purvanchal Expressway (The Week, June 2025). It does not cross Basti.
Basti-specific corridor project
We found no dated expressway, industrial corridor or airport project inside Basti beyond the NH-227B notice. If a seller cites one, ask for the notification or tender document and its date.
Land-use declaration under section 80
A 2026 amendment treats a building or layout approval in notified development and industrial areas as the declaration of non-agricultural use (PRS; TeamLease RegTech). Confirm how it applies to a village before relying on it.
Agriculture & terrain
Soil, water & sugarcane in Basti
Basti is intensively farmed alluvial plain with shallow groundwater, two named sugar mills and a Ghaghara flood edge.
๐พ Soil and crops
The CGWB profile describes clay (matiyar), loam (dumat) and sand along the high banks of the Ghaghra, generally calcareous and of medium fertility. Net sown area was 2,090.17 sq km in 2010-11, with 68.89% irrigated (CGWB Basti profile). The district industrial profile lists sugarcane, oilseeds, cotton, paddy and wheat as main crops (district industrial profile). The Soil Health Card portal holds village-level data; we did not open it.
- Alluvial plain
- Sugarcane
๐ง Water
Average annual rainfall is about 1,166 to 1,170 mm, 87% of it from June to September. Groundwater development was 75.43% as of 31 March 2009, ranging from 58.07% in Ramnagar to 89.43% in Bankati, and all 14 blocks were classed safe. Pre-monsoon depth in 2012 was 2.75 m at Kalwari to 5.67 m at Basti. Arsenic above 50 ppb appeared in 12 of 3,104 samples (CGWB Basti profile). These data are old; ask for the block's current category.
- Safe blocks
- Arsenic watch
๐ Rivers and floods
The Ghaghra forms the southern boundary, and the Kuwana and its tributaries (Rawai, Manwar, Katnehia) and the Ami, a Rapti tributary, drain the district. In the monsoon the Ghaghra overflows and its channel shifts, moving land between banks (CGWB Basti profile). We found no flood-hazard map, so ask the district administration about a village's flood history.
- Ghaghara
- Kuwano
๐พ Mandi price reference
Wholesale prices for district mandis are published daily on the Agmarknet portal; we did not open it for this page. Crop income is a real part of value in a densely farmed plain, but price a parcel on flood exposure and access first.
At a glance
Basti and Gonda: groundwater and rainfall side by side
| District | Groundwater stage (CGWB profile) | Rainfall | Price evidence read |
|---|---|---|---|
| Basti | 75.43% (31 Mar 2009); all 14 blocks safe | 1,166 to 1,170 mm (CGWB) | No sourced price series |
| Gonda | 79.30% (31 Mar 2004); 15 blocks safe, 1 semi-critical (CGWB Gonda profile) | 1,151.8 mm (CGWB) | No sourced price series |
| Ghazipur | Block stage not read | 976.7 mm (ICAR-CRIDA, 2012 plan) | No sourced price series |
The three districts are different markets. The table compares published groundwater and rainfall figures only; the CGWB profiles are older documents (2004 to 2012) and the figures are not like-for-like or a ranking.
Farmland India view
Why investors look at Basti
Three reasons this desk includes Basti, with a plain note that price evidence is missing.
Road and rail already in place
The industrial profile counts 74 km of national highway and 54 km of rail line in the district. Access is an existing fact, which is more reliable than a promised corridor.
Shallow, adequate groundwater
The CGWB classed all 14 blocks safe at 75.43% development in 2009, with shallow pre-monsoon water. Irrigated farmland is the norm, though arsenic needs testing.
A cane and paddy economy
The industrial profile lists sugarcane, paddy and wheat among the main crops and two sugar mills. That suits agri-business plans better than a pure land-banking thesis.
Confirm flood history, arsenic test results and holder status directly โ these are not certified by Farmland India's review.
STRAIGHT TALK
Risks & challenges in Basti
Read these before shortlisting in Basti specifically.
Ghaghara and Kuwano flooding
The Ghaghra overflows its banks in the monsoon and shifts channel. Ask for a village flood history from the district administration and avoid pricing from a dry-season visit.
Arsenic in groundwater
The CGWB profile found arsenic above 50 ppb in 12 samples across six blocks, and CGWB 2024 lists Basti above 10 ppb. Test any borewell before building a farmhouse or drinking from it.
No sourced price series
We found no official or news price series for farmland here. Do not anchor to numbers from neighbouring districts; collect registered comparables from the Sub-Registrar.
Fragmented holdings
The industrial profile's population over the CGWB area works out near 850 people per sq km (our arithmetic), which suggests small holdings. Check the khatauni for co-sharers and consent before agreeing a sale.
Data age
The CGWB groundwater stage dates from 2009 and the profile from earlier surveys. Ask for the latest block category.
NRI and OCI buyers
FEMA prohibits NRIs and OCIs from buying agricultural land, plantation land or a farmhouse (RBI, updated September 2022). Families abroad should read the Uttar Pradesh page before shortlisting.
Conversion and ceiling rules
Non-agricultural use needs a section 80 declaration, and a buyer's total holding in Uttar Pradesh is capped at 5.0586 hectares, about 12.5 acres, under section 89(2) (UP Revenue Code text, IGRS UP). The 2026 amendment changes the conversion route in notified areas; confirm what applies to your village.
Who to contact
Local revenue & registration offices
Agricultural-to-non-agricultural declarations under section 80 of the UP Revenue Code, and mutation, route through the Tehsildar and SDM of the relevant tehsil; confirm the tehsil first, since Harraiya is the only one we could name from a document. Sale-deed registration is handled by the local Sub-Registrar, and khatauni extracts are on UP Bhulekh and IGRS UP; we did not open either portal for this page. Read the UP agricultural land rules guide before filing anything.
